1. Acceptance of These Terms

By downloading, installing, or using the Vizea mobile application (“Vizea”), provided by Tunahan Aktay (“we”, “our”, or “us”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, do not use Vizea.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country if higher, to use Vizea. If you are under the age of legal majority, use the app with your parent or guardian’s permission.

3. License Grant

You may use the app for your personal use, under Apple’s Standard EULA described below. Images you create are covered by section 4. All rights not expressly granted remain with us and our licensors. These Terms supplement Apple’s Standard Licensed Application End User License Agreement. If the two conflict about your license to use the app, Apple’s agreement applies.

4. User Content

• Ownership: You retain all rights to the images and content (“User Content”) you add to your boards.
• Processing License: You grant us, and the AI providers named in our Privacy Policy, a limited, worldwide, royalty-free license to process the goal prompts you submit to provide vision-board scene generation. Personal photos are composed locally and are not submitted to the AI providers. Service records and retention are described in our Privacy Policy; completion of generation does not guarantee immediate deletion by providers. We do not acquire ownership of your boards or personal photos.
• Results: As between you and us, we claim no ownership of the generated images or boards you create. You may export and share them for lawful purposes, including commercial use, subject to third-party rights and applicable law. AI output may not be unique or eligible for copyright protection. We do not guarantee that an output is free of third-party rights. You need any permissions required for photos of other people.
• Responsibility: You are solely responsible for your content. Only add photos you have the right to use, and obtain any permissions required before sharing images of other people, including children.

5. Subscriptions & Purchases

• Subscriptions: Vizea offers subscription plans for board creation, AI-generated scene photos and Home Screen widgets. Browsing templates is free; creating boards, AI generation and widgets require premium access. The purchase screen shows the available plan, duration and price. Automated or abusive use is not permitted. Service availability may also be affected by provider limits.
• In-App Purchases: Subscriptions are sold through Apple’s in-app purchase system. Apple handles all payments, taxes, and billing.
• Renewal & Cancellation: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple ID settings.
• Refunds: Apple handles all payments, so refunds are requested from Apple at reportaproblem.apple.com. We cannot issue refunds ourselves.

6. Prohibited Conduct

You agree not to:

• Upload or use offensive, illegal, or harmful content.
• Violate any applicable law.
• Reverse-engineer, modify, or exploit Vizea’s technology.
• Use bots or scripts to abuse the system.
• Resell, copy, or rebuild the Vizea service itself.
• Use photos of others to mock, harass, impersonate, or deceive them.

7. Intellectual Property

All content in the Vizea app (logos, code, UI, designs, text, and graphics) belongs to us or our licensors. You may not use them for commercial purposes without permission. Any feedback or suggestions you provide can be used freely by us without compensation.

8. Privacy

Your privacy is important. Please read our Privacy Policy to understand how we collect, use, and protect your data. It forms part of these Terms.

9. Disclaimers

Vizea is provided “as is” and “as available”. Vision boards, affirmations and generated scenes are for inspiration. They do not predict or guarantee that a goal will happen and are not medical, mental-health, financial or other professional advice. AI-generated images may contain inaccuracies and may not meet your expectations. Features and templates may change, and AI providers may be unavailable at times. Boards are stored locally; deleting the app can remove them. Keep exports or backups of content you want to preserve. Shared or exported copies and device backups are managed separately. Nothing in these Terms limits rights you have under mandatory consumer law.

10. Limitation of Liability

To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for Vizea in the 12 months before the claim. This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.

11. Indemnification

You are responsible for claims arising from content you use in breach of these Terms.

12. Termination

• By You: You may stop using Vizea at any time.
• By Us: We may suspend or terminate your access if you violate these Terms or misuse the app.
• Effect: Certain clauses (User Content, Intellectual Property, Disclaimers, Liability) will survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Turkey. You agree to resolve any disputes through the courts of Turkey, unless local consumer protection laws offer you additional rights.

14. Changes to the Terms

We may update these Terms. We will announce significant changes on this page or in the app before they take effect, and update the date above.

15. Miscellaneous

These Terms, the Privacy Policy and Apple’s Standard EULA form the entire agreement between you and us. If any part is found invalid, the rest remains enforceable. You may not transfer these Terms without our permission.
